1. Acceptance of Terms

Welcome to DaaS ("Platform," "we," "us," or "our"), operated by DaasDotCom Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Shivam Vihar, Doon University Campus, Kedarpur, Dehradun, Uttarakhand – 248012, India.

By accessing, browsing, or using the DaaS website, mobile application, or any related services (collectively, the "Services"), you confirm that you are at least 18 years of age (or have obtained parental consent), have read and understood these Terms & Conditions ("Terms"), and agree to be legally bound by them. If you do not agree, please discontinue use of the Services immediately.

These Terms constitute a legally binding agreement between you ("User," "Buyer," or "you") and DaasDotCom Private Limited, and are supplemented by our Privacy Policy, Cancellation Policy, and Returns, Exchange & Refunds Policy, all of which are incorporated herein by reference.

2. About the Platform

DaaS is an online marketplace that enables independent third-party sellers ("Sellers") to list, offer, and sell products to buyers located in India and other supported regions. DaaS itself is not the seller of the products listed on the Platform unless explicitly indicated otherwise.

We act as an intermediary and facilitate transactions between Buyers and Sellers in accordance with the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020. The contract of sale is directly between the Buyer and the respective Seller. DaaS is not a party to that contract.

DaaS reserves the right to modify, suspend, or discontinue any part of the Services at any time with or without notice, and shall not be liable for any such changes.

3. User Accounts

3.1 Registration

To access certain features of the Platform (such as placing orders, tracking shipments, and managing wishlists), you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@dassdotcom.com if you suspect any unauthorised use of your account. DaaS will not be liable for any loss arising from your failure to safeguard your credentials.

3.3 Single Account

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, access promotions fraudulently, or for any other abusive purpose is strictly prohibited and may result in permanent suspension of all associated accounts.

3.4 Minors

Our Services are not directed at individuals under the age of 18. If you are a minor, you may use the Platform only under the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

4. Prohibited Conduct

You agree not to engage in any of the following activities:

• Violating any applicable local, state, national, or international law or regulation.
• Using the Platform for fraudulent purposes, including placing fake orders or submitting false reviews.
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation.
• Uploading or transmitting viruses, malware, or any other harmful code.
• Attempting to gain unauthorised access to any portion of the Platform or its related systems.
• Scraping, crawling, or harvesting data from the Platform without prior written consent.
• Using automated bots, scripts, or other tools to interact with the Platform in an unintended manner.
• Manipulating prices, circumventing promotional terms, or abusing refund or returns processes.
• Posting content that is defamatory, obscene, hateful, threatening, or invasive of privacy.
• Engaging in money laundering or using the Platform to finance unlawful activities.

Violation of any of the above may result in immediate suspension or termination of your account, removal of your content, and legal action where appropriate.

5. Marketplace & Sellers

5.1 Third-Party Sellers

Products sold on DaaS are offered by independent Sellers who have agreed to our Seller Terms of Service. DaaS does not own, store, or ship most products and is not responsible for the quality, safety, legality, or authenticity of items listed by third-party Sellers.

5.2 Product Listings

DaaS makes commercially reasonable efforts to ensure that product listings are accurate and up to date. However, we do not warrant that product descriptions, images, prices, or availability are always accurate, complete, or current. In the event a product is listed at an incorrect price due to a typographical error, DaaS reserves the right to cancel such orders and issue a full refund.

5.3 Seller Responsibility

Sellers are solely responsible for the items they list, their accuracy, compliance with applicable laws (including FSSAI, BIS, legal metrology requirements as applicable), and for honouring the sale. Any disputes regarding product quality, mismatch, or non-delivery should first be raised through our Resolution Centre before pursuing any legal remedies.

6. Payments & Pricing

6.1 Pricing

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless stated otherwise. Shipping charges, if any, are disclosed at checkout before you confirm your order.

6.2 Payment Processing

Payments are processed through PCI-DSS compliant third-party payment gateways. By providing payment information, you represent and warrant that you are authorised to use the designated payment method and that the information provided is accurate.

6.3 Order Confirmation

Receipt of an order confirmation email does not constitute acceptance of your order by DaaS or the Seller. An order is considered accepted only when it has been dispatched and a shipment confirmation has been sent to you. DaaS reserves the right to cancel orders at any time before dispatch for reasons including stock unavailability, pricing errors, or suspected fraud.

6.4 GST Invoices

A GST-compliant tax invoice is generated for every purchase and made available in your account under "Order History." This invoice is issued by the respective Seller, who is responsible for their GST compliance.

7. Intellectual Property

All content on the DaaS Platform — including but not limited to the DaaS logo, trademarks, trade names, website design, graphics, text, software, and code — is the exclusive property of DaasDotCom Private Limited or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial shopping purposes only. You may not reproduce, distribute, modify, display, or create derivative works of any content on the Platform without our prior written consent.

If you believe any content on the Platform infringes your intellectual property rights, please send a notice to legal@dassdotcom.com with the required details under the Information Technology Act, 2000.

8. Disclaimer of Warranties

The Platform and its Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. DaaS does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

DaaS makes no warranties regarding the accuracy, reliability, or completeness of any product information provided by third-party Sellers.

9. Limitation of Liability

To the fullest extent permitted by applicable law, DaasDotCom Private Limited, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the Platform, even if advised of the possibility of such damages.

Our aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the amount actually paid by you for the order giving rise to the claim in the twelve (12) months preceding the date the claim arose.

Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act, 2019, or any other applicable mandatory law.

10. Account Termination

You may deactivate your account at any time by visiting your Account Settings or by contacting our support team. Upon deactivation, your personal data will be handled as described in our Privacy Policy.

DaaS reserves the right to suspend or permanently terminate your account, without prior notice, for breach of these Terms, fraudulent activity, or any conduct that we determine, in our sole discretion, to be harmful to other users, Sellers, or the Platform. Outstanding obligations (such as unpaid dues or pending disputes) survive termination.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations within 30 days of written notice.

If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand, India. Consumers also retain the right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, and may file complaints on the Government's INGRAM portal.

12. Changes to Terms

DaaS reserves the right to update or modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform at least 7 days before they take effect. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes. It is your responsibility to review the Terms periodically.

For consumer grievances, you may also contact our Grievance Officer at grievance@dassdotcom.com. We endeavour to acknowledge all complaints within 48 hours and resolve them within 30 days of receipt.
